Phillipsburg Man Charged with Sexual Assault of Juvenile

Acting Morris County Prosecutor Fredric M. Knapp announces that Barry Miller, 42 years old,

of Phillipsburg, New Jersey, has been charged with one count of Second Degree Sexual Assault.
Defendant is alleged to have engaged in multiple acts of oral penetration in the past with a victim who was between the ages of 13 and 14 when the acts allegedly occurred. The victim alleged that the defendant would provide him alcohol and gifts in exchange for sexual favors.  The acts are alleged to have occurred in Phillipsburg, New Jersey between February 18, 1996 and February 17, 1998.
Defendant was arrested on April 15, 2014, and charged with one count of Second Degree Sexual Assault.  The investigation was handled by Morris County Prosecutor's Office Detective James Bruno and the Phillipsburg Police Department.
The Honorable Maritza Berdote-Byrne,J.S.C. set bail at $75,000 cash, bond or property without a 10 percent option, along with the condition that there be no contact with the victim and no unsupervised contact with children under the age of 16.  Defendant must forfeit any weapons. The defendant is currently lodged in the Warren County Correctional Facility.

A criminal complaint is merely an accusation.  Despite this accusation, the defendant is presumed innocent unless and until he or she has been proven guilty beyond a reasonable doubt in a court of law.
