The New Jersey Public Records Act, N.J.S.A. 47:1A-1 to -13, allow for public access to government records, with several exceptions (listed below).

The Morris County Prosecutor’s Custodian of Records must notify you within (7) seven business days from receipt of your request as to whether your request will be granted or denied, unless exceptions are made by law.

If the record requested is not currently available, is in storage or is archived, the custodian will advise you within (7) seven business days of when the record can be made available and the estimated cost.

Important Information for Public Access to Government Records

Your request is not considered filed until it has been delivered to the Morris County Prosecutor’s Office.

Fees for duplication are printed on the requestor form. Our office will notify you of any special charges, special service charges, or other additional charges authorized by State law or regulation before processing your request. Payment is accepted in cash, certified check or money order payable to the Morris County Prosecutor’s Office.
Requests with estimated fees over $25.00 require a 50% deposit. You agree to pay the balance upon delivery of the records.
By state law, a custodian must deny access to a person convicted of an indictable offense, in New Jersey, any other state, or the United States, who is seeking government records containing personal information pertaining to the person’s victim or the victim’s family.
You may be denied access to a government record if your request would substantially disrupt agency operations and the custodian is unable to reach a reasonable solution with you to accommodate your interest and the interests of the Morris County Prosecutor’s Office.
Except as otherwise provided by law or by agreement with the requestor, if the custodian fails to respond to you within (7) seven business of receiving a written, signed request form, the failure to respond will be considered a denial of your request.

Denials

If the Morris County Prosecutor’s Office is unable to comply with your request for access to a government record, the custodian will indicate the reasons for denial and send you a signed and dated copy.

New Jersey statute provides for a right to appeal any denial or failure to provide access to a government record.

If your request has been denied or unfilled within the time permitted by law, you have a right to challenge the Morris County Prosecutor's Office's decision.

You may either institute a proceeding in the Superior Court of New Jersey or file a complaint in writing with the Government Records Council (GRC), located in the Department of Community Affairs.
